Question by Marie A.: My daughter recently violated probation because she was in a drug rehab and missed a probation visit. She did n?
She did notify her PO when she went in to the 10-30 day detox and rehab program.A few days after her missed PO visit I have 9 Broward County FL fugitive apprehension team on my door step.I don’t want her to have to go back to jail when she’s trying to do the right thing, we can’t afford a private attorney, I can’t understand why she’s being punished for doing the right thing. Is there some way to resolve this without her having to go back to jail? Her probation officer never even tried to call to let her know he would violate her for missing an appointment, doesn’t she have a right to treatment?

Sounds like SHE has a “Problem”- that You should probably stay OUT Of. Her Parole Officer is gonna have to figure out what to “Do”- about THIS One… 🙂

She does NOT have a right to treatment. She broke the law and there is a right to Justice. She violated her probation by not showing up to an appointment. She should have had someone from rehab bring her to her appointment. Or she would have needed to apply for change of her terms of probation in order to miss the visit while she was in rehab. She will most likely be arrested. She can discuss this with the judge when she appears in court for her violation. The judge may let it go. Or he may sentence her to more time and longer probation. I know you think your daughter is just a helpless little angel. But to the law, she’s nothing more than just another criminal drug user.
